Champions Club Terms and Conditions

1. Introduction
1.1 Champions Club members (“members”) are defined as individuals who are registered with The Surf Life Saving Foundation ABN 47 945 812 553, ACN 159 849 591 (“The Foundation”) in accordance with clause 2 below for a monthly automatic plan (“plan”) to receive entries into the Foundation’s prize home lotteries (“tickets”), of which there are six (6) each year, and run in accordance with the conditions available here. By purchasing a plan, certain members will also be entitled to entries into a series of promotions (“Promotions”) as outlined in these Terms and Conditions. For the sake of clarity, the more a member spends in their monthly plan, the higher their chances are of winning as they will be entitled to more entries, at the rates set out below. The total maximum value of all prizes to be awarded in the Promotions is up to $762,000. For the avoidance of doubt, the Foundation is the promoter of the Promotions. The first Promotion starts 1 July 2020 and the final Promotion closes 11:59pm AEDST 30 June 2021.

2. Registration
2.1 To register as a member, you must provide your name, contact information and credit card / financial institution details, and selecting an amount for your automatic monthly plan through any one of the follow methods:

3. Prize Home Lotteries
   3.1 Each month you will receive an allocation of “tickets” to the value of your automatic monthly Champions Club “plan”
   3.2 The minimum monthly spends is $2 (a total of $24 per year)
   3.3 Each prize home lottery campaign (“campaign”) runs for approximately two months, meaning that you will receive two ticket allocations per lottery
   3.4 Your credit card will be charged – or, in the case of direct debit payments, your nominated bank account will be debited – to the value of your automatic monthly “plan”
   3.4(a) On the day that each prize home lottery opens and
   3.4(b) Approximately four (4) to five (5) weeks later
   3.5 You should receive your tickets within 15 working days of each successful monthly automatic purchase transaction.

4.2(f) The winner will be notified by telephone and registered mail within two (2) business days of the draw & their name will be published in The Australian newspaper on the 3^rd business day after each draw as set out above.
4.2(g) The Foundation may conduct redraws 3 months after the original draw at the same time and place as the original draw if the winner of the first draw has not claimed their prize by this time. The winner will be notified by telephone and registered mail within two (2) business days of the draw & their name will be published in The Australian on the 3^rd business day after the draw as set out below.  Any unclaimed prize draws will take place on the following dates, subject to the directions of any regulatory authority:

To be eligible for the chance to win a Seasonal Bonus draw, a Champions Club member (“entrant”) must be:

7.1(a) An “active member”, defined as an individual with a current active banking auto-instruction (to charge a credit card or debit a nominated bank account) with the Surf Life Saving Foundation;

7.1(b) On a monthly automatic plan of $10 or more with a successful transaction within five (5) weeks prior to the close date of the Promotion; and
7.1(c) 18 years of age or older and an Australian (excluding Western Australia) or New Zealand resident

7.2 Prize Details & Draws

7.2(a) The winning eligible entrant in each Promotion is entitled to win $25,000 (AUD) cash except the winner of the Easter 2019 Promotion who will win $50,000(AUD). The total prize pool for each Seasonal Bonus Promotion excluding Easter 2019 is $25,000 (AUD) cash. The total prize pool for the Easter 2019 Promotion is $50,000 (AUD) cash.

7.2(b) Prize must be taken as stated and cannot be redeemed for alternative prizes
7.2(c) The prize draw for each Promotion will take place at the following dates and times in the presence of an independent scrutineer.

7.2(e) The first valid entry drawn subject to the eligibility of 7.1 will receive the relevant prize for the promotion. The Foundation reserves the right to draw out reserves entries, in the case of an invalid or ineligible entrant.
7.2(f) The winner will be notified by telephone and registered mail within two (2) business days of the draw & their name will be published in The Australian on the 3^rd business day after the draw as set out above.
7.2(g) The Foundation may conduct a redraw 3 months after the original draw at the same time and place as the original draw if the winner of the first draw does not claim their prize by this time, subject to the directions of any regulatory authority. The winner will be notified by telephone and registered mail within two (2) business days of the draw & their name will be published in The Australian on the 3^rd business day after the draw as set out below. 9. General Terms

 

9.1 The Foundation reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Foundation has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of any Promotion. Errors and omissions may be accepted at the Foundation’s discretion. Failure by the Foundation to enforce any of its rights at any stage does not constitute a waiver of those rights. The Foundation’s legal rights to recover damages or other compensation from such an offender are reserved.

9.2 Conduct of the entire Promotion, including decisions on the eligibility of persons to enter and situations or issues for which these Terms and Conditions make no provision or are unclear are the responsibility of the Foundation, whose decision in all matters will be final and binding. No correspondence will be entered into.

9.3 Participation in a Promotion by an entrant indicates acceptance of the Terms and Conditions governing each Promotion by the entrant. All cash prizes will be awarded in the form of a cheque (or EFT if the winner requests and nominates a bank account).

9.4 Each winner consents to having their name or anonymous variation posted on the Surf Lottery website (https://www.surflottery.com.au) and Surf Lottery Facebook page (http://www.facebook.com/surflottery). Their name or anonymous variation may be used for Surf Life Saving Lotteries future promotional, marketing and publicity purposes.

9.5 If any Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Foundation, including but not limited to technical difficulties, unauthorised intervention or fraud, the Foundation reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

9.6 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Foundation (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of any Promotion and in particular: (a) any technical difficulties or equipment malfunction (whether or not under the Foundation’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Foundation) due to any reason beyond the reasonable control of the Foundation; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

 

10. Changing Membership Details
    10.1 You can change your membership details by e.g. increasing or decreasing the amount of your automatic member monthly plan, by calling 1800 642 999 (AU) or 0800 442 501 (NZ). Changes to your automatic monthly plan will be effective from the next automatic monthly debit

 

11. Cancelling Membership
    11.1 You can choose to cancel your membership at any time by:
